Samantha Sutherland is an Associate at Turnpenney Milne LLP, practising in all areas of workplace law and conducting impartial workplace investigations. She acts for both employers and employees, and is dedicated to creating healthy, safe and productive work environments. She provides practical advice to employers on HR issues, accommodations, and workplace policies, and represents clients in wrongful dismissal, constructive dismissal, severance negotiations, and human rights disputes.

In her advocacy practice, Samantha’s background in the alternative dispute resolution space positions her to work collaboratively with clients to pragmatically resolve workplace disputes, seeking meaningful outcomes through settlement negotiations, mediation – and, when needed, litigation.

Samantha’s investigations practice covers a wide range of issues, including discrimination, harassment (including sexual harassment), workplace violence, bullying, misconduct, and poisoned work environments. Samantha also works with organizations to restore and maintain positive workplace cultures, providing training, cultural assessments, and post-investigation remediation and facilitation.

Her interest in human rights spans both her advocacy and neutral roles. She regularly advises employers on complex accommodation and equity matters, represents employees and employers in human rights disputes, and investigates sensitive human rights complaints as a neutral investigator.

Samantha obtained her Juris Doctor with distinction from the University of Western Ontario. While at Western Law, she was a Student Mediator at the Dispute Resolution Centre, a Student Caseworker at Community Legal Services, and a Pro Bono Students Canada volunteer delivering public legal education. She graduated on the Dean’s Honour List, placing in the top 10% of her class each year, and received several awards, including the Labour Law Award for top academic standing in labour law, the Morris Kroll Memorial Award for access to justice work, the Dean Ivan C. Rand Award for contributions to the Faculty of Law community, and the Law Society of Ontario Prize for academic excellence (awarded to the top 15 graduating students).

In her spare time, Samantha is usually hiking outdoors in some of the world’s most beautiful locations, whether that’s the Rocky Mountains, the Grand Canyon, the coast of Portugal or Machu Picchu.
