Litigation

Most employees are daunted at the prospect of initiating a claim against a current or former employer.  While litigation may be a necessary step in seeking and enforcing our client’s rights, at Turnpenney Milne LLP it is not our first step but rather our recourse if alternate dispute resolution methods are unsuccessful.  In many instances we are able to negotiate a settlement on your behalf without the need to initiate legal proceedings in the courts.

We have experience at varying levels of court and with the Rules of Civil Procedure that govern the various courts.  We also have experience litigating a wide range of cases relating to the workplace.  Those claims involved the following (this is a non-exhaustive list):

  • Wrongful and Constructive Dismissal
  • Denial of STD and LTD benefits
  • Denial of bonus payments
  • Breach of contract
  • Contractual disputes relating to benefit entitlement
  • Wrongful Competition and Departing Employee claims  (i.e. cases involving non-solicitation and non-competition clauses)
