In 2008, the government introduced sweeping changes to the manner in which human rights issues are handled in Ontario. Four years later, it called for an independent review of the system to gauge how effective those changes have been.
Andrew Pinto’s much anticipated report on the Ontario human rights system was released today – November 8, 2012. In his 233-page report Pinto reviews the ‘three pillars’ of the human rights system – the Ontario Human Rights Commission, the Human Rights Legal Support Centre and the Human Rights Tribunal of Ontario.
Of significance to many of our clients – both Applicants and Respondents at the Human Rights Tribunal – are Pinto’s recommendations to improve the way in which matters proceed through the Tribunal process; to eliminate the requirement of disclosure of documentation at the early stage of proceedings; to dedicate greater resources to mediation at the Tribunal; and to provide a more transparent mechanism for publicizing data on awards (particularly public interest remedy awards) and terms and conditions of settlements. Most notably, Mr. Pinto also recommends that the Tribunal reconsider its current approach to general damages awards, suggesting that the monetary range of those awards should be significantly increased.
The last of these recommendations will be welcomed as long overdue by those representing employees/applicants at the Tribunal or in the Courts where human rights violations can now be adjudicated. Despite the removal of the cap on general damage awards, in the almost 4 years since the legislative changes were introduced, we have yet to see any really substantial damages awarded for egregious human rights violations.
